Dispute Resolution
ANDREW TAYLOR - PARTNER
Our dispute resolution team has helped to resolve disputes as wide-ranging as the intellectual property rights of high fashion shoe design to the valuation of fields of lavender.
Most businesses will experience commercial disputes at some point. We aim to help clients avoid disputes developing where possible and, if they do occur, to manage them in a robust yet economic manner. We use the court process and adapt our style, to suit the circumstances of each individual case, always remembering that value for money is extremely important for clients.
At the earliest stage we work to try and avoid litigation. Disputes can be avoided by ensuring a regular review, at least annually, of terms of trading and intellectual property rights, which we undertake with other specialists within the firm. If a dispute cannot be avoided, we understand that clients want a quick and commercial resolution and this remains our prime objective.
We are recognised for our ability to identify commercial solutions to help achieve this goal. If these solutions prove difficult to accomplish, we remain determined and resolute in achieving our clients objectives through litigation. We work to minimise the risks and uncertainty in dispute resolution and provide clients with an early risk analysis in respect of their dispute.
We always think tactfully and creatively, which enables us to anticipate potential issues and problems ahead and either avoid them completely or respond to them in a quick and effective manner.
We work on hourly rates, fixed fees and conditional fees in appropriate circumstances and will seek to discuss flexible fees and risk sharing with you. We consider financial transparency and regular reporting on costs to be a high priority. Indeed, this is something which we have been commended for in the Legal 500.
Faced with difficulties, clients turn to BPE because it gives value for money, is highly competent and constantly reminds us of the need to weigh costs of litigation against benefits.
