Family Law Myth 1: The mother always ‘gets’ the children

MYTH: The mother always ‘gets’ the children

REALITY: A mother will not automatically ‘get’ the children when parents separate. If an agreement cannot be reached between the parents regarding with who the children should live, then it will be necessary to apply to the Court to decide. This is known as a Child Arrangements Order and will outline with who a child is to live and what time the children should spend with the other parent. The Court will base its decision on what is best for the children, and it is by no means automatic that the children will live with the mother.
