The Equal Pay Saga at Asda Continues

7,000 employees at Asda brought a group equal pay claim in the Employment Tribunal in 2016. After the employees succeeded in that claim, Asda appealed to the Employment Appeal Tribunal, the judgement of which has now been released. This is the largest private-sector equal pay claim ever made in the UK and is attracting a lot of attention as it progresses through the court system.

The “Great Repeal Bill”: How great is it really?

On 13 July 2017, Parliament was presented with the European Union (Withdrawal) Bill for its first reading. You may already know about this bill. It was initially called the Great Repeal Bill by Theresa May’s Government. Employment tribunal claims involving direct discrimination are a rare occurrence as it is often easy to identify when an employer is deliberately discriminating against a protected group. Because of this employers rarely commit direct discrimination. However, claims involving indirect discrimination are more common as indirect discrimination is normally harder to identify. A recent Supreme Court case has however clarified the test to prove indirect discrimination and highlighted how easily an employer can do something innocently and still be found to be indirectly discriminatory.
