Divorce & Family Issues

Legal issues surrounding any personal dispute will always have additional stresses and issues. Our private client and family teams understand the sensitive nature of family proceedings and the long term impact and issues that can surround them.

Protection

Taking out an injunction

If you or your children need protection from domestic abuse, we can provide support and advice to make sure appropriate legal safeguards are put in place. We can also help protect money or property at risk from being spent or sold by obtaining injunctions from the Court.

Injunction to freeze assets

If you think your spouse is trying to dispose of assets to try and reduce any financial settlement, the best action is to seek legal advice straight away. If either party is found to have hidden an asset, the courts will take it very seriously. We can help protect money or property at risk from being spent or sold by obtaining injunctions from the Court.

Inheritance Tax Planning

If the value of your assets exceeds the inheritance tax threshold, we can advise you on how you might be able to reduce the tax bill on your death. This might mean some re-structuring of your assets during your lifetime and maybe considering the use of trusts in your Will. Trust have the added benefit of offering some protection over your assets should there be a divorce in the family or if you have children from an earlier relationship and want to ensure that both children and your current spouse are looked after.

Our team can also advise on Deeds of Variation, which enable you to divert funds from a loved one's estate to someone else that you nominate to help with personal tax planning. Finally, to offer a full package of support we can also put you in touch with independent financial advisors and accountants to advise on your wealth management

Who can deal with my finances if I lose capacity?

Powers of Attorney aren't just useful for caring for the elderly, they should be considered by everyone with financial assets. There are two types of Lasting Power of Attorney - one deals with wealth and finances, the other deals with more personal issues, such as any specific wishes you have about the medical care you receive in the future.

With people living longer, we all need to put plans in place for people to manage our affairs if we are unable to do so. You cannot assume that your spouse or loved one will automatically be able to make decisions for you. That's why we recommend putting Powers of Attorney into place as soon as possible.
