We regularly act for actual or alleged recipients of State aid, awarding authorities, and public bodies. We advise undertakings in various, often high profile, projects that involve diverse State aid advice, frequently involving an application of the Research Development & Innovation Framework.
State aid advice can be crucial when dealing with issues at the interface between the public and private sectors. Funds or resources flowing from the public purse to the private sector may amount to prohibited state aid and these issues must be dealt with by notification to the European Commission for approval or structuring to bring the aid within an exemption.
Our work includes the identification of potential state aid issues, structuring aid to fit within the European Commission’s block exemption, de minimis rules and sector specific frameworks, and notifications to the European Commission for approval.
