You snooze you (may) lose: Guidance on “on-call” shifts for national minimum wage purposes

This article considers recent EAT guidance in three combined appeals of Focus Care Agency Ltd v Roberts, Frudd v The Partington Group Ltd and Royal Mencap Society v Tomlinson-Blake in respect of "sleep-in" shifts for national minimum wage purposes. There have been a number of cases dealing with working time and on-call time. The appeals in these cases however explored the question: are employees entitled to the national minimum wage whilst on call or sleeping at work?
