Family Law Myth 7: Pensions are not matrimonial property
MYTH: Pensions are not matrimonial property
REALITY: Pensions that have been accrued during the marriage will be taken into account when dividing matrimonial finances. If one party’s ability to accrue a pension has been compromised, due to reduced earning capacity i.e. to raise children, then this will also be taken into account and the Court may order one person’s pension to be shared.
