Construction & Engineering Seminar with Hill International

BPE have joined with Hill International to bring you an interactive seminar detailing all the essential information surrounding variations and adjudications and will particularly look at the following issues:

VARIATIONS - Just because it’s different doesn’t necessarily mean it’s a change...!

Changes to the works on construction projects are a common cause of dispute, leading to thousands of adjudications, arbitrations and court claims in the UK every year.  When it comes to assessing variations, the outcomes are often complex and the battle to establish whether something does or doesn’t constitute a change and to what extent still dominates final account disputes.

John Jones of Hill International and Anna Wood of BPE Solicitors will give insights into these issues, including:

  • The issue of design responsibility and development, contradictions in documentation, omission of works, changed conditions and valuing of variations
  • An overview on how the UK’s most popular standard form contracts deal with variations and will suggest amendments which should benefit both parties.

LIFE AFTER ADJUDICATIONS - Feedback and lessons learned

This seminar, presented by Paul Mansell and John Jones of Hill International and Neil Mason of BPE Solicitors, looks at life after the adjudicator's award. 

Increasingly adjudication is the dispute resolution process selected by parties yet because of its private nature little factual information is known of  the trends and issues that arise. Paul and John look to lift the lid.

There is also a growing trend of losing parties fail to pay and Neil will give his top tips on adjudication enforcement from both sides of the fence.  The session will focus on:

  • How the payer might attempt to resist an enforceable court judgment;
  • Recent developments and case law which arose from Adjudication proceedings
  • How the payee under an adjudicator’s award seeks to have it turned into an enforceable court judgment;
  • How the payer might attempt to resist an enforceable court judgment;
  • Methods of enforcement for turning the award and the judgment into money; and
  • How an instance of litigation after adjudication recently gave rise to a new implied contractual term and a unique limitation period.
