Contractual advice in respect of anaerobic digestion plants in the UK
These range from clusters of 120KW in Scotland to a 24MW in Devon. Procurement routes include IChemE Red Book, MF/1 and bespoke delivery agreements. We assisted the client with its suite of security bonds, which had to be heavily negotiated with their Austrian bank to be accepted both in Vienna and the UK. This called for creativity and pragmatism in approach.
Biogest, an Austrian company, has designed and installed anaerobic digestion plants at numerous sites across Europe, on all their UK sites. Procuement routes include the IChemE Red Book, MF/1 and FIDC Yellow Book as well as bespoke delivery agreements. Key performance indicators and appropriate division of risk is critical to the success of Biogest’s projects.
In conjunction with DLA Piper in Vienna, we also advise on cross jurisdiction issues including, for instance, the client’s security package from its funders to their customers.
