Restrictive Covenants: what are they and how can they be enforced?
Every business wants to protect its interests, the intangible and invaluable assets that it owns, the important strategic plans and commercial information; as well as access to their key clients, suppliers and workforce. In order to do this, some employment contracts contain restrictive covenants, with the objective of trying to limit the activities an employee, director or shareholder (or all three) can undertake whilst they’re employed/engaged and once they leave the business.
This is a very useful tool for employers, but it is one that an employer needs to impose reasonably in order to protect their legitimate business interests. Head of Employment at BPE Solicitors, Nick Rowe will discuss how restrictive covenants and other related provisions, such as notice and confidentiality provisions can best be deployed and how they can be enforced and defended.
